This is almost like philosophy of law. Interesting. I'm actually leaning towards the control mania perspective since hell, a lot of people should learn by now that internet = you can't see the face of others != anything can be said without a clear conscience.
Nevertheless, controversial topics like incest/pedophilia topics will always remain active somewhere no matter what LiveJournal does. It'd be a lot of work banning them without a clear result in sight. Can LJ staff alone really pull it all out? Things continue to remain in the dark~

The problem is that LJ is not coming up and saying "we can ban you for whatever we want." They're hiding behind legal arguments that don't even apply (according to the TOS, LJ is bound by United States law, and under U.S. law you can write all the incest and kiddy erotica you want as long as no real illegal incest or real children are involved-- something that isn't true in many other English-speaking countries, including Canada and Australia). Nobody did a thing illegal on LJ except for the tiny number (especially when compared to the number of people caught in the crossfire) real pedophiles, and they need to quit saying that those people did.
I'd have a lot more respect for them if they came out and said "we make more money from advertising than we do from paid accounts, and so we buckle to advertiser pressure even on issues where our account holders have the higher legal ground." I wouldn't like it, but I'd prefer honesty to ( ... )

I guess I thought that sort of went without saying. Livejournal is a business, not a utopia, and I'm not sure if fandom always understands that. Granted, I guess LJ itself tries to hide that fact. I'm with you in wishing they'd be more honest about that.

Of course, the main difference between the argument against advertiser pressure then was (hilariously enough) that the advertisers in the copyright infringement actually could legally force LJ's hand but LJ was still assuring us they wouldn't take it; for users in the United States, at least, they could not in this particular situation but LJ folded almost immediately.
I do have to say, though, I've been reading news and the next time a Canadian or Australian says "BUT WHY AM I SUBJECT TO U.S. LAW?" I'm going to hold off on the "you agreed to it with the ( ... )

P.S. It was finals week, I didn't have time, and I also own the Nash, Chris, and Suiko II listings. So, I thought if someone else wanted to apply...they should. But now I might apply for it. Hmmm.

Uh, yeah, I know my opinion is differing from the rest of my flist, but whatever. I'm afraid if I made an entry saying the above, a whole bunch of people would jump down my throat and I just can't bring myself to care enough about it. Not when KAIN IS IN 3D AND BEING AWESOME BY SIMPLY SKULKING IN THE SHADOWS. Haha, it's funny how I was all unsure of this remake, and all they had to do was show Kain and I change my tune pretty quickly. ♥
