Well, it's an amendment to the State Constitution, which I'm pretty sure would put it out of the hands of the justice system. Can't have a court declare it unconstitutional, because it's in the Constitution. Lame with a side of lame-sauce.

So.

1. How does one go about getting an initiative on the ballot?

2. Does anyone know a lawyer who can write up the legalese?

So, there's some discussion about the fact that it may qualify as a revision (2/3 vote) rather than an amendment (50%). Although it was already submitted as such to the SCOCA before the election, they might have just been not bothering until it was already voted in. So, step 1 is bringing it before the Supremes again (assuming step 0, win after absentee ballots are counted, fails):

Then there are a number of challenges that can take it to SCOTUS.

As to your specific questions:
1. You collect a certain, fairly low, number of signatures.
2. Yes, I think the noon8 people, the HRC, and a number of other pro-gay groups are coordinating efforts in that direction as well as the assorted court battles.

Oh, the specific number of signatures varies every time the governor is elected. There's a pretty good handbook on the CA SOS's website.

I was just having this discussion with my mom, actually. I was saying that I'm pissed enough that if someone decided to gloat about it in my presence that I'm not sure my normally cool head would prevail. I was talking about having to deal with that anger without becoming the type of person I am angry with.. without becoming an example of the same hate and prejudice I am proud to stand against. It ain't easy.. but that's overstating the obvious, I imagine. It is hard sometimes to remember that people cannot be strong-armed into believing something.
