I get different answers from different people on this question. I even contacted her literary agents in October to get the straight scoop. Here's what their:
I don’t believe we sent out an official statement, but I know that we have said in respect to online fan fiction that this is fine, as long as it’s non-commercialised (i.e. not for sale) is appropriate e.g. not pornographic and that the person who writes the fan fiction uses their own name and does not try to attribute his or her work to JK Rowling.
On Ms Rowling’s website, in response to a frequently asked question, Ms Rowling responded as follows:
Will you use some of my ideas in the next Harry Potter book? The books have been planned for so long that there isn't room for any more ideas! Fan fiction is really fun, though, and I am so proud to think that Harry Potter inspired so much creativity!
I'm pretty sure Jo has said that her issue with pornography is that the series is aimed at children, and children will naturally be looking online and consequently may stumble

Having been your editor on some of that NC-17 stuff I can say with certainty that there can be no stone casting. Although, I would point out that your stuff was by no means something that perverted a very natural act. Sex, fetishism and all things along those lines can be something interesting and wonderful to read about when there's a balance struck between the physical and the emotional and it's not sex for sexes sake. I'm all for good erotica, but there has to be a reason for them to jump into bed together or the scene has to illicit some emotional response from me other than a.) ewww or b.) that is so not physically possible, does the man have three hands?
That's my two cents anyway. And since I can't throw stones either, I'll just leave it at that.
One thing about your writing that I always have envied was how you managed to write the most romantic sex ever, by focusing primarily on the emotions as opposed to on where everyone's hands were. And yet you still kept your readers very much in the moment. Sigh... It sure would be lovely if you would write some more of that!
