you are posting a lot today and things like that are overlooked a lot very few people know that Australia has no Bill of Rights. No Freedom of Speech or anything here it is a bit different because we ASSUME since we are a democracy that these rules exist when they don't :(
Well, actually it says that the PRIVILEGE of a writ of habeas corpus shall not be suspended.
A privilege is something that people have... or they don't have. You can't say that people still have a privilege if you withhold it from them. The act of denying it is the same as suspending it.
It would be like saying that Freedom of Speech doesn't actually apply to individual people... If it doesn't... what's the point?
Another note, there are two specific caveats to Article 1, Section 9, Paragraph 2 (the section that mentions habeas corpus)...
unless when in Cases of Rebellion or Invasion
This puts the needle to neo-con apologists who say "Lincoln suspended habeas corpus!!" Well yeah... he had a constitutionally valid exemption.
I see no rebellion. I see no invasion.
Gonzales's legal "theories" should be openly and soundly mocked.
*smacks forehead* People like him and the people who believe him are the reasons we have so many stupid warning labels like "This is not a toy" on plastic bags. He also reminds me of the kids that have just grown out of their "why" stage but still want to be annoying. The kids will grow out of that stage too in time - I doubt this guy will.
Ok, maybe I don't know lawyer speak, and I'm just a stupid American sometimes, but I am just not getting his comment and why it's so bad. Don't worry, I don't see why it's good for his side either, but still.
