Wow, at least you can keep the vehicle. Here if the insurance company writes it off they get to keep it and you can't touch it. My brother-in-law found out the hard way when he backed into his neighbour and busted a tail light and dented a corner panel on his aging mini-van. They way he figured it he had never made a claim in his life so he would call the insurance. THEY WROTE OFF THE VAN. Told him not to drive and got it towed away. Within 24hr his wife and children were vehicle-less (okay they had a rental), but you get the picture.
The icon cracks me up to this day. I remember that from seeing you around RQ. I used to sit there and watch that whole thing play out.
Here the laws vary from state to state. I'm sure there are some states where the insurance companies have more leeway to pull the vehicle out from under you.
In Michigan's case, the vehicle gets what's called a "salvage title" that ultimately removes any resale value you may have had. My Econoline wasn't worth that much to start with, tho...plus I had planned on driving it till it quit anyway. Win-win, baby.
