I'd have to say that the house elves definitely are not free during the battle. But they seem to be acting of their own accord, which is kind of fantastic.

Excellent point!

I think it is a bit murky who the Hogwarts elves are bound to but it seems unlikely that it is the students as they rarely cross paths.
