Age of Consent

Sep 17, 2012 21:40

I thought I was clear, but I guess not, so I apologize. This meme does not allow under 16 prompts. 16 is the most common age in the show, and it would be hard to have a meme otherwise. But we do not allow ages below 16 in prompts. We don't want to get TOS'd. For the purposes of this meme, 15 us chan/shota/hardcore underage. There have been some chan ( Read more... )

I'm sorry but I'm honestly still confused: chan/shota/hardcore underage says nothing to me in terms of age aka actual years, and you mention 16 years old as being underage several times but not once can I make out do you mean to say it's against comm rules or not?

I can make a wild guess and say your post was meant to convey that folks should keep all sexual activity in prompts to 16-or-older, but I couldn't prove that by quoting your post. This is why we feel that 16 is young enough neither confirms nor denies that prompts with characters of that ages involved in intercourse will be deleted.

So maybe you could just clear it up a bit, for folks just want to know what goes and what doesn't, in cold hard numbers? (And especially those not from the US or countries where the legal age of consent start at 14 or 16, so their view of "severe underage" might be skewed from the start?) Thanks!

For the purposes of this section, a "minor" is a person
under the age of 18 years and an "adult" is a person
who is at least 18 years of age.

Meaning anything under 18 is to be considered underage. At least that's how I interpreted the post. Idk.

I'm just confused by the This is why we feel that 16 is young enough part; young enough for what? To get the comment deleted? To not get it deleted? *hands*

Why not create a separate post for underage prompts? That's how other kinkmemes on LJ do it, too.

I'd second that. Some underage fic is fantastically written, why should we miss out on those great fics, when other kink memes get to have them? Take SPN for example, there's hundreds of underage fic on there and they didn't get kicked off LJ.

The rules for this meme have always been nothing under 16. This is not new, just because I have announced it. I announced it because I noticed people who have not read the FAQ and Rules making these prompts.

This rule is not changing.

Do I understand (a) correctly in that sex between a minor and an adult is allowed as long as they're married? And would that same apply for "bonding" aka werewolf marriage?

And what I don't get from this post is: Does 16+ fall under that "severe underage" thing or only everything under 16? Sorry if this is a stupid question but the way this post is worded makes it a bit ambigious

I understood this post to be saying no under 16 fics. I could be wrong, but I'm pretty sure that is what the mods are saying. : )

I get what your saying but this really doesn't make sense to me considering the main pairing for TW is Sterek and it's an underage pairing by nature. Are you saying that on a kink meme there can be no canon R+ prompts...cus that seems odd.

I'm pretty sure that it's the state in which the person is publishing/distributing the questionable material that matters, not the state where the fictional characters are having sex. The relevant law in the U.S. is obscenity law, not "Age of Consent" law. As far as I know (disclaimer: I am not a lawyer) U.S. child pornography law only applies to visual depictions, not textual works.

There's also the problem of jurisdiction in the internet age.

We are going by the TOS here for the most part, and by what allows us to still function as a meme. The rule for the community has always been no under 16, anyway, so by making this announcement I'm making people aware of the rules, not changing anything.
