Drabble-ish : There's still hope...if you think like Jack

Jack's utterly logical and code-friendly explanation of why going back for precious cargo isn't stealing ;)

Yes, this is backed up by the Pirates' Code Guidelines (Pg 39, I so do swear)

Title: A Captain's Authority
Rating: G
Spoilers: Yes, for AWE
Characters: Jack, Barbossa, mentions of Elizabeth and briefly of Will
Pairing: Implied Jack/Elizabeth, and the background canon of Will/Elizabeth, though questionably so.
Word Count: Roughly, a little under 600
Summary: Henry VIII is ever so envious of Jack's logic...

"She's a married woman, Jack," came the voice of infuriating reason that was Hector Barbossa, just as Jack was on the verge of ordering to turn the Pearl about. Well, nevermind on being decisive.
"So?"
"She has a duty and she'll only turn you away."
Already making his utterly innocent way across the deck - his deck - Jack was ignoring every word out of Hector's overly-large mouth, though he also noted no orders were yet being shouted from his own. He'd change that...soon.
"You came in second rate, Captain - there's no dancing around that."
Jack froze in mid stride, causing an unsturdy wobble that was unusual when he didn't have any alcohol in his blood...well, any was a strong word...
At first his pause was of obvious bitter realization. However, the very wording of such an offending comment hit him with another, far more pleasant realization as well. Turning around sharply on his heel, a sly smile begged to tug at his lips.
"Says who?"
Barbossa actually looked vaguely taken aback, if only for a moment.
"Well, that's obvious, who'd she marry?"
Jack smirked, starting to wander close to his challenger, sauntering a half-circle about him.
"Who says she married anyone?"
"I do."
"And why is that, Hector?"
"I performed the ceremony, I think I'd know."
"Precisely! And why did you perform said a ceremony?"
By this time Hector was looking bored with Jack's logic, his eyes rolling skyward.
"The lady asked it of me."
"And why would she enquire such a thing?"
"Because only a captain could've married them."
"Ah ha! But you were not a captain, so all is null and void. Thank you for your help, mate, I won't forget it!"
Dumbfounded, Barbossa retorted only after momentarily watching Jack flounce toward the helm.
"And by what authority do you claim that?"
Turning back on his heel for the second time, Jack sounded almost as if he were explaining a most complicated process to a small child, which deepened the already apparent scowl on Hector's features.
"I claim it by a captain's authority. As of the time said ceremonial proceedings took place, I was still captain of this ship."
Barbossa had opened his mouth to protest, but Jack had none of it.
"Aa! No. In order for you to have become captain, the crew would've had to vote me out by majority, and then after such an unlikely thing occurs, vote you in," Jack persisted with a look of vague disgust. "And as neither of these occurences had and indeed have not occured, I was still captain of this ship and you were captain of no ship."
"I'm a pirate lord!"
"That does not under any circumstances, make you a captain - the only position on the court that requires being a captain is King, and you are obviously missing a crown. And under the non-rights of your uncaptaincy, any and all captainly things you did are null and void, including but not limited to the marriage of one Miss Swann and a now undead-ish Captain Turner. So, if you will excuse me, I have orders to give."
"Didn't stop you from naming yourself Captain Jack Sparrow even when I had order of the Pearl, did it?"
Jack barely bothered to explain the various and exceedingly large differences between his situation and Hector's on his way to reach Gibbs.
"I merely claimed of the title, I did not partake in any duties that require literal captaincy, nor did I perform any marriages. I retained the title because I knew it was rightfully mine, stolen or not. Not to hold the authority."
For once Barbossa couldn't fathom a reply, giving leave for Jack to shout the final orders, sealing his fate and his conscience with the previous reassurences. Now, he just needed to convince her as well as he convinced himself...
