So, it's been over five months since we moved out of the rental house in Jarrell. We STILL haven't gotten our deposit back, and I've gotten almost no response to my inquiries. I'm tired of it, and I finally feel good enough that I'm doing something about it. When I'm feeling *RAWR*, do not irritate me.

That should do it.

I had several similar issues. Once a letter is sent, return receipt requested, and the body of the letter cites statutes, most landlords will say "crap, they know the law," and write a check that very moment.

I really hope so. I don't really want to get into a legal froo froo right now, but I will. Especially because I've been really really nice up until now.

Now, they're going to get the annoyed me. :-D

Go get the scumbag(s).

They do this kind of thing because they figure they can get away with it because few (ex)tenants are willing to do more than whine.

I assume you have a lawyer you can get to send the follow up in a week and that you have copies of any previous correspondence to/from them. You probably also ought - no matter whether they pay up in 5 days or not - report them to the Better Business Bureau and any local government agency that handles rental stuff etc.

The only way to stop these tactics is to cause the landlords pain and grief

Part of me feels bad, because they're a nice enough family, but part of me is *really* honked off. Don't play these games if you can't afford the stakes. Seriously.

If they want to get involved with business relationships that are specifically addressed by statute, then they need to know the law and act within it. Being just regular folks instead of a big company does not excuse them from acting within the law.

Believe me, no one wants to go to court. And most people don't have to. Once these people understand that you're serious, they'll probably send you a check. It's a cut and dried situation that they can't win. The only possible result would be that they're court-ordered to give you three times as much, and they can't want that if you're willing to settle for just the deposit amount.

I agree with the fact that they're just ordinary people not excusing them from the requirements of the law.

And you know...when we rent out our house, I'm putting the deposit into a separate account, to just sit there for a year (or whatever.) That way, when it's time to return it, or use it to fix whatever...it's there.

To me, that seems like the best idea.
