Yes, more on scans_daily.

So, we're still working on our official mod statement - press release, if you could call it that - but in the meantime, stubbleupdate and I (with some behind the scenes input from schmevil) did an interview with comicmix.com. So if you don't want to wait to read about our account of the 28th, s_d's official position on fair use, and some hints of where we plan to take ( Read more... )

Um ... proooobably not? I'm still in denial that people can link me together if they don't already know me. XD

You can call me Tindy! Everyone does. Although ... I'm thinking of changing my handle again.

I know I basically bailed on the community due to real-life issues and a dwindling interest in comics, but I must say, you've handled everything wonderfully and I'm proud of you.

I enjoyed a quick read through the comicmix interview just now, and think you (collectively and individually) did a good job with it.

Just a couple quickies.

Firstly, I don't want to scare you below; I think you are all in pretty good positions wrt civil liability. Moreover, I am still willing to bet that there simply is no legal threat, and that this is all the result of some functionary (possibly a TOS volunteer) at LJ used his or her own opinion -- and here I don't mean a legal opinion -- to shut down the community unilaterally. That is, there was probably no DMCA notice (LJ is obliged to share that with you and let you make a counter-notice) or C&D letter (ditto, almost) from a publisher at all. In some ways I hope that's right. In other ways, it's pretty gross that anyone would flip a switch like that on thousands of people's collaborative work with no notice or explanation.

Secondly, I started a thread in the comments of some comments by foresthouse on the subject of s_d and fair use that may be of interest (or may be ( ... )

Heh, I have stuff in the shuffle too...

I'll come back to this shortly, but I first just wanted to recommend these excellent links:

http://www.citmedialaw.org/legal-guide/fair-use [really, truly well-compiled]

and

http://www.eff.org/issues/intellectual-property/guide-to-youtube-removals

which is appropriate by analogy, and which has good stuff in the "Two Background Facts" and "But WIll They Sue Me?".

I didn't ignore your question about help about the press release / statement, and I think I've scattered semi replies around (i.e., since you are a Kevin Bacon away from EFF people, actually talking with those people by phone might be a good idea ( ... )

Another amusing thing: we're totally discussing scans_daily in CMS this morning and I feel very much like a Super Cool Insider. :>

Hahaha, what did you say? DID YOU MAKE ME LOOK GOOD? (Kidding.) Actually, although I get the gist because I know what you do, I have no idea what CMS stands for.

This feels tremendously awkward, actually, because I wanted to ask you for advice about what you do and whether I'm in the right degree and whether, when I get my health in order, I should consider applying for a program more like what you do (I ... really doubt MIT would accept a transcript like mine at this point >_>), so the overlap is a bit... um.

We should totally talk about this! Are you ever on IM anymore? I feel like we haven't caught up in a long time. I don't even know what health issues in particular you're referring to (!) because I disappeared from fandom for such great swaths of time and also didn't so much check LJ ever. Which is embarrassing, because I still count you as one of my Great Fandom Friends. But yeah, I'd love to talk about this...

Oh, and CMS = Comparative Media Studies. And yes, I made you look good. ;)

E-mail me with your IM! I'm around kind of sporadically - it sort of depends on whether I remember to turn the darn thing on. XD
