The normal ebay etiquette here would be to apologize that UPS damaged his item, remind him he did not pay extra for insurance, but that as an act of good faith you will accept the item and refund his money minus actual shipping charges. The guy will probably bitch anyway, but at least you can comment that you offered him a refund and he refused.
yea, but that would still leave me screwed w/ ebay fees for listing and selling the item. plus i already tried to apologize for what happened, but the guy is just being a prick about the whole situation.
