Вполне закономерно, что после катарсиса в виде первого в жизни ареста, дальнейшее шло, как серая череда дней. Как пишут злопыхатели: “пока мы вкалывали, ты не работал, хвастался интересными приключениями и ездил на пленер”. Я бы к этому списку еще добавил настольный теннис, в котором за этот год небывало продвинулся играя по всей Корее с самыми сильными доступными игроками, которых старался заинтересовать если не техникой то “турнирной выкладкой”…

17 марта, после имиграшки поехал в посольство. Показал бумаги. Спросили: “уверен, что тебе это надо”. Сказал да. Обещали помочь. Посоветовали адвоката.

23 марта посольство дало мне копию ноты (24-34) и я с адвокатом приехал в имиграшку. Выяснилось, что хоть Exit Order и нельзя отозвать (в пределах иммиграционного закона), но его можно отсрочить. Есть даже специальная форма, выдается имиграшкой “из под полы”, если поймут что адвокат есть и не отстанут:

Оптимизаторы финансов из J&H правда тогда не знали, что при получении ALIEN ID я записался гарантом мамы. И поэтому лишить они ее ничего не могли, “через имиграшку”. Что правда не помешало попытать счастье с полицией, но это другая история.

6 апреля, за день до окончания и так увеличенного на месяц дела по сверхурочным, районный клерк Минтруда, ранее получивший копии бумаг из SBC, не имел другого выбора, кроме как обязать Компанию выплатить деньги. Правда, выли учтены только пол дня в субботы “т.к. больше доказательств мною не предъявлено”. Сумма была смехотворной, но все же это была победа:


Крайний срок “по хорошему” стоял 17 апреля

Компания признала долг, а так же написала мне:

28 апреля состоялось заседание Комиссии по Трудовым Конфликтам г. Сеула. Президент и администратор вели себя очень заносчиво и когда им сказали прекратить нарушение Закона Кореи, восстановить меня в должности и выплатить зарплату за весь период громогласно заявили, что не собираются исполнять это решение. Тем не мене комиссия дала J&H и мне две недели, чтобы “помириться”.

29 апреля я получил очередное месячное продление.

Как я значительно позже узнал, 12 мая (зная что сейчас выходит письменное решение комиссии) J&H написала в имиграшку следующее заявление (привожу целиком, выделено мной):

Written Petition
May 12, 2004
TO: Director of Seoul Immigration Office
CC: Person in charge of civil service
RE: Matter of visa E-7 of Olexander, Shapir
(Foreigner's registration number: 680604-***)

1) Thank you always for the support provided from your office.
2) I apologize for causing inconvenience to your office on the matter of the above case. The employment relationship of our company with above foreigner was terminated from the contract, and we have "reported for cause of change in employment of foreigner" to your office as of February 24, 2004.
3) Prior to report for cause of change in employment of foreigner, we notified to the said person several times to come to your Immigration Office verbally and in writing, but he did not contact at all, and he once notified us to report independently of our own. Therefore, we made several inquiries on phone to the Immigration Office and we were confirmed that we would have to report the matter of changes alone if there is no other choice and we did report.
4) And, the above foreigner caused many damages to our company and not moved out from the housing that the company had provided (for 3 months) and caused physical damages to the company, and he further demanded money when there was no justification under the employment contract, and he brought a complaint of illegal dismissal to the Ministry of Labor, causing time and mental damages to the company.
Furthermore, the raising of this problem to the company was the same with the problem that he caused in same method in LG Electronics Research Center in Woomyeon-dong, Seocho-gu, Seoul, his previous employer in Korea, demanding money other than his wage and raising many problems in relation to his duties, and he received the wages for two months without working for the company in compensation, and he provokes the same problem in our company to this point.
The foreigner person above was a person dismissed from our company under Clause 1-2 (Termination of Agreement) of Article 11 of Employment Agreement, and the employment relationship with the company was terminated on February 23, 2004, and he was requested to move out from the company housing for several times without avail that the company contacted the police office to compulsorily taken to SeoulImmigration Office on March 17, 2004, and was taken away his foreigner's registration card and order of departure was issued with the company in attendance. (As of the departure period of March 31, 2004, we do not know how long the Immigration Office provided the delay of departure). Therefore, the above-named foreigner filed complaint against the company to the Labor Commission for unjust dismissal, and asserted that he was unjustly dismissed by the company to the Embassy of Ukraine in Korea and continuously postponing the visa in Korea.
5) Our company develops software, hardware and system in the IT fields with the domestic patents and foreign patents. The above foreigner came on to the Seoul Research Center of our company at around 9:00 in the morning of February 19, 2004, and took the photographs of inside of the research center and took them out of the center without authorization, and the police officers required him to present the unauthorized photographs, but he still had the unauthorized photos in his possession and legal actions have been taken now. (In this case, our company had to bring legal resort to have them back.)
6) From the unauthorized absence and early withdrawals, there is no longer an employment relationship in accordance with the termination of the employment agreement for foreigner, the company no longer considers any type of relationship at all. We think that the foreigners like him who talks of his personal problems as if the company made mistakes and yet attempted to stay in Korea have to be deported immediately to have no more such disputes. Therefore, this written petition is filed herewith
