We got the solicitor's prelim report on the house we want yesterday. Seems they slipped it into the market with a short lease so it is currently unmortgageable. GAH! Good news: the council own the lease and are obliged by law to sell the lease to the owner if he asks. Bad news: this is a probate sale and there might be questions whether the ( Read more... )

Sorry to hear that. Buying/selling houses is a nightmare, isn't it?

Oh, and the perfect icon for your post.

I found it on an LJ comm called (I think) british_comedy.

Well it was British money, British studios and a British TV channel so I think they have at least equal claim. :) We do tend to specialize in exporting our best talent (which is why the likes of Daniel O'Donnell ( the real Eoin McLove)) do so well at home.

I spoke to our solicitor and barring extra hidden bullshit it shouldn't be a problem. The leaseholder is the corporation who are legally bound to sell freehold to the current owners. The fee is negligible.

Fingers crossed.

Worth pressing before giving up, I feel. Especially if the council WANT the property to sell. Let your solicitor earn their extortionate fee, and sort it out with the executor. If the fee is negligible then the executor should be willing.

Indeed. I spoke to our solicitor today and he seemed to think it should be straightforward to resolve.

He was still recommending that we get our own house sold first, which I take as a positive sign.
