It's awful, but if the mother has been in jail for five years, her son has been fostered out and the American family took him on for a closed adoption, I'm not surprised her case got turned down. Biological parents are not always the best people to raise a child. Bear in mind I don't know how American social services works, but I will agree that her not being provided with a translator is incredibly callous.

True in some cases, but it sounds like this decision has been made on the fact she was in the country illegally. To me, that's not a strong enough argument for taking somebody's child away.

Or the decision was made not because she was undocumented but because her undocumented status led to her being jailed and thus unable to parent? (Not that this is completely cut-and-dry obvs)

I find it pretty awful that somebody with a young child (11 months is still a baby!) can be jailed for being undocumented tbh. I find it very hard to believe anyone would work illegally in a chicken processing factory, risking arrest, deportation and jail time just for the lolz. This is fucked up.

not having a translator is illegal, ability to assist in your defense and all. i am curious so to how long she was detained etc after the raid. my understanding from reading other sources is that she was detained for a while and the boy was originally left with family but when that fell through he entered the foster care system and was fostered and later adopted by this couple.

Seems to me like the letter of the law was followed, hopefully the adoptive parents will allow for visitation by the biological parent.

JFC, I cannot believe I'm reading this. As a (then) underage daughter of an illegal immigrant, I have no words. This is wrong on every possible level. Getting thrown in jail, losing your home, your job, your whole life, if you will, AND losing your child on top of that? I am so sad for that woman.
