So, at last there are some hopeful developments in this ugly story from last fall.  A high school teacher who raped his 14-year-old student and then received a 1-month sentence AFTER violating the terms of his probation and AFTER the girl committed suicide, is having that disgustingly-lenient sentence reexamined by a new judge.  And the judge is ( Read more... )

So...raping a 14-year-old is fine if she looks older? How about NO, with a heaping side of FUCK YOU.

Wednesday's decision cited in part the actions of District Judge G. Todd Baugh (baw) of Billings, who suggested the young victim shared responsibility for her rape because she had some control over the situation.

NO SHE FUCKING DIDN'T. She's a child and someone she should have been able to trust used his authority to take advantage of her. I wish being a revolting human being were illegal so this piss-poor excuse for a judge could go to jail too.

This is exactly what the appeals court judge said that it was impossible for her to have had ANY control. Sounds like the appeals judge was seriously pissed off.

As someone pointed out in the comments in the source, child victims of sexual abuse often begin acting like they're older than they actually are BECAUSE of the sexual abuse they're enduring. This isn't brand new information and a judge should be very well-aware of it. Instead he used this to justify the abuse. I have no words.

I remember this story. And all I can say is, bring on that disciplinary action for the judge ASAP! Especially if "disciplinary action" = removing him from the bench, which it certainly should in a case like this.

I saw something elsewhere that said the original sentence violated minimum sentencing statutes, so scumbag rapist is going to do some serious time once they resentence him.

As for that shitastic judge, I hope they remove him from the bench. (I don't think it will happen, but maybe they'll prove me wrong.)
