Frankly, after Gold said the ink was what caught him, not the quill - I've decided he allowed himself to be captured. Pretended the whole thing. So that he could tell them Emma was the savior - he manipulated it all. Regina doing the curse - everything.
I've always assumed Rumples let himself get captured. And yeah, Regina made her own choices, but he did his best to make sure she was so warped and unhappy that she'd think the curse was her only way to win.
