I agree with everyone above saying that you are in the right and the buyer is at fault. But, and this is a big but, eBay does not allow sellers to leave negative feedback. It has no such restriction for buyers. So if you refuse to take the shirts back, the buyer could leave you negative feedback that cannot be deleted and you cannot do likewise.

I thought a negative feedback could be disputed.

They changed that a few months back over here and I was under the impression that this was worldwide.

One of the bigger German power sellers actually already sent someone a cease & desist letter because of a groundless negative feedback and even with that signed letter, eBay refused to delete it.

I agree that the buyer should have asked for measurements or at least checked with the Avenue's website for a size chart. It's what I would have done. But not everyone does. They bid, they pay and then when the item doesn't fit, they bitch ( ... )

But the item wasn't "not as described." It was exactly as described.

It won't matter, ebay will usually side with the buyer anyway.

I know your items were as described, I am not disputing that. But the buyer will do whatever they can to get their money back. If they file a "not as described" claim, or do a chargeback on their credit card, you will be out the money AND the shirts, because they won't have to return them.

By having her return the shirts, you at least can relist them.

Considering what another poster had mentioned about having to refund the money, but having the shirt to re-sell, you might want to err on the side of caution. It is entirely possible that someone is trying to play the eBay system to get a "free" item; if they do side with the buyers as often as everyone seems to be saying that is. I would suggest having her send it back to you at her expense, refund it, then list it again stating that this is an "as is" purchase or something along those lines or list measurements. I don't think it's so much as being in the wrong or the right, it's making sure she doesn't get your clothes and your money!

Lori, I would e-mail her and say just what you have said in your journal end of story. Love Mom
