Common sense is one thing. Having taught constitutional law is another...at the very least, for not having to rely for legal advice from persons who 1) lost an election to a corpse 2) don't have any real experience other than serving as legal janitor to a silver-spoon jerkoff and 3) lent their name and effort to getting Roy Cohn off the hook he so richly deserved.
