Legal Help! Auto Accident....

I was in a no-fault accident back in February and the other person's insurance (which is Allstate) took full liability for the accident. They paid off my lien less $500. When I lived in KCMO I served on a jury in a whiplash/chiropractic car accident case. We awarded the defendants less than the insurance company was offering. I think a lot of people are pretty unsympathetic when they have to take time off work to serve for cases like that, just FYI.

The problem with the idea of a jury of one's peers is that peers are pretty often assholes.

It's easy for me to say it's no big deal to serve on a jury - I'm salaried, so no overtime is lost and they pay me my regular salary as long as I turn over the 'jury' check - but I could see some of the other people's points. And, try as you might, when you're losing overtime money you depend on that's going to bleed over into resentment towards the people who brought the lawsuit. No, it's not fair, but we do live in a sue-happy society and I think people are just getting tired of it.

eh... well i got in a wreck with a drunk driver (cuz she was stopped in the center lane of i-35 at 2am on a friday while her children were home alone) and i'm wondering if the less $500 you mention is from your deductible...
i have state farm and since my car was totalled, they paid me the value of the car, minus my deductible so i could have it right away, then went to the other insurance company to get their money back. they are supposed to eventually get my $500 back from the other insurance company also... it's been over a year and a half, but the stupid woman kept filing continuances in court so who knows how that delayed things :(

The $500 less isn't from my deductible because I didn't claim through my insurance. I used his insurance because they claimed liability.

Five years ago I was in a minor fender-bender (not in KC) but ended up with severe back injuries. I was in intensive therapy for nine months, couldn't walk due to the severe pain for nearly three months, have six different doctors in different cities even on the record stating that I am going to have permanent and long-lasting negative issues resulting from my injuries, and I am in pain pretty much all the time as a direct result of the accident ( ... )

My mother has been dealing with the same problem for over 2 years now. She was rear-ended when she was at a dead stop. The guy that hit her was going about 50 mph. Unless you received REAL medical attention (chiropractors don't count) then you're more than likely screwed on the legal side of things. My mom had so much stress that her hair started falling out.

Anyway, the insurance company told her that because she didn't accept the ambulance ride offered, she could have just as easily gotten whiplash from some other accident and would not pay.

My best advice....hire a lawyer and possibly see a doctor ASAP.
