Apple/Woolworths Logo Fight

Apple is trying to fight Woolworths from changing their logo because they say that their classic "bite of the apple" logo is being ripped off by Woolworths.

What do you think?

It's absolutely ridiculous. Not quite as ridiculous as T•Mobile thinking they have sole ownership of the color Magenta, but close.

Well, to back down a little, there are some good points being made over at Brand New.

It sounds like it might be true that this is pretty standard procedure when a new mark is filed. Also, someone brought up the good point that part of maintaining (legally) your trademark protection entails "actively and vigorously" pursuing potential violations. So even if this particular logo isn't a big threat, the very act of pursuing it helps protect the apple logo in the future.

Still silly, though.

I don't think look anything a like. Just because its an apple with a leaf doesn't mean its too similar to Apple's logo. The Woolworth's logo is OBVIOUSLY a "w" in the shape of an apple not an apple with a bite out of it.

On a side note...There is a grocery store in Florida where I use to live that is called the Apple Market. I believe that store have been around WAAAAY longer than Apple and the grocery store's logo is an actual apple with a bite out of it. So if this store had that logo first, who gets the copy right?

Usually there is no legal conflict as long as the organizations are in different industries and there is no likelihood that the logos can cause confusion. I'm still trying to figure out how Apple and Woolworth's markets are similar enough, though…

Apple don't own the rights to all stylised depictions of apples. This should be thrown out of court.

wow i never saw that - what a cute logo!!! and also not apple's logo either. they don't own EVERYTHING that is shaped like an apple lol.. unless they were able to copyright *actual* apples??!?.... uhoh...
