Re: Money - the best thing to do would probably be to pre-sell paid or permanent accounts. I for one would gladly plink down $40 (which is the cost of a permanent account on insanejournal) knowing that it was going towards getting a fandom community up and running.

This is the applicable law currently on the books in the United States. The information below can be found at the U.S. House of Representatives web site at: http://uscode.house.gov/download/pls/18C110.txt

This law is dated 01/02/2006, which indicates there have been no changes or amendments to it since that time.

Items #9 and #11 are most pertinent.

Pay close attention to the very last sentence, girls and boys. I even put it in bold for ya. This is a bit longer than the 4300 characters allowed, so the last sentence will be on the next post ( ... )

Other law is involved.

1466A. Obscene visual representations of the sexual abuse of children

(a) In General.- Any person who, in a circumstance described in subsection (d), knowingly produces, distributes, receives, or possesses with intent to distribute, a visual depiction of any kind, including a drawing, cartoon, sculpture, or painting, that-
(1)
(A) depicts a minor engaging in sexually explicit conduct; and
(B) is obscene; or
(2)
(A) depicts an image that is, or appears to be, of a minor engaging in graphic bestiality, sadistic or masochistic abuse, or sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex; and
(B) lacks serious literary, artistic, political, or scientific value;
or attempts or conspires to do so, shall be subject to the penalties provided in section 2252A (b)(1), including the penalties provided for cases involving a prior conviction.

Some gaming sites I know host out of Malaysia/Taiwan/etc because the laws are different enough there so that possible copyright infringement issues, et cetera, aren't going to have an impact on their hosting. That, I think, should be kept in mind for the fandom project, since you'd be looking for a country which a) has a low age of consent and b) is lax on copyright infringement issues and reaction to C&Ds.

Another issue that I haven't seen mentioned much is fandoms OTHER than HP. I think that in order for this to really work, they have to move as well. I don't actually think that will be too terribly hard if the legal reasoning is explained, considering that HP has its hooks in everybody to some extent. Still, you might be wanting to consult with prominent/influential people in other fandoms pretty early on in the process.

Thanks for bringing up other fandoms--I heartily agree. Anime fandoms have the most to lose out of all fandoms on LJ, since 90% of the characters either are underage or look that way.

In case you are not aware, there is a fannish journaling site called JournalFen. It is presently not very large, having been put together years ago. I'm not sure how active the site mods are. However, if you want to go with someplace that *has already* been started by fen, you might be able to work with them to update the source code, expand the hosting, etc. FYI.

Huh. I'm quite aware of JF, but I admit that the idea of working with them hadn't really occurred to me. It may be worth looking into, but I think that if fandom as a whole were going to go there, they'd have done so already. The other concern is that JF is only for those over 18, and many are uncomfortable excluding a pretty large chunk of fandom based on age.
