Danger of HIV infection in this fashion may soon be a thing of the past anyway... Microbicides are coming down the pipeline that kill HIV but not sperm. I think they're about five years away.

Still, I've never understood why they don't just bloody well test the damn sperm/blood.

Reliability. The likely hood of a single test being incorrect is small, however when you start processing the number of people that organizations like CBS does, the law of large numbers really starts to come into play and the likelyhood of contamination rises.

This is totally dumb. These consenting adults are being denied the right to conceive. The method is irrelevant.

I think the case is being a bit misstated. Keep in mind the guy could still donate his sperm. It's just that men in higher risk categories have to go through a different process, that involves special screening. Maybe not perfect, but overall not tragically unfair either.
