S has been working 7 hour days.  For a while.  My work hours are 10-6:30 so I can avoid traffic (a hold-over from the other site where I had to drive across the river).  So to figure out exactly what was going on I had to come in almost an hour early on random days over the last couple weeks and gather data.  She's been coming in at 9:45 and ( Read more... )

Yes, I have been paid for lunch break I have worked IF I was not able to leave the building, and had to remain on duty for the entire time.

That's a pretty specific instance, and I am going to guess that she is allowed to leave for lunch.

However, her math skills are poor!

Actually, the scenario you describe above violates Oregon law. Employers are required to provide a 1/2 lunch break after 5 hours of work. If an employee works 6 hours or longer, you must also allow two 15 minute paid breaks or 15 minutes every four hours in addition to the 1/2 unpaid lunch. You are not allowed to require an employee to work through lunch. Recent Oregon rulings have caused HR lawyers to counsel employers that they should require employees to take lunches and breaks to avoid potential lawsuits, up to and including disciplinary action for employees who do not do so. Yup...I told her repeatedly when she started that she was required to take a 1/2 hour lunch break daily. She used to go out walking in the other building and I know at one point she was working a whole 8 hours.

Maybe she's Canadian. Up here it is the law that you must get two fifteen minute (paid for) coffee breaks on a full shift plus a lunch break which isn't paid for. If you don't take your coffee breaks you still get paid for them.

That's actually the law here too. Which I've explained to her. What makes it even more baffling is that she has about 20 years of management experience. I wonder if she just really wants me to fire her?

We get paid for 7.5. With a 30 min unpaid lunch break...(that sometimes get stretched to an hour...hehehe)
But I eat lunch at my desk a lot, so the occasional hour lunch is cool with "da man"
