Court: Dying can be charged for using marijuana

SAN FRANCISCO, California (AP) -- A California woman whose doctor says marijuana is the only medicine keeping her alive is not immune from federal prosecution on drug charges, a federal appeals court ruled Wednesday.

The case was brought by Angel Raich, an Oakland mother of two who suffers ( Read more... )

I think it's completely wrong any way for the government to tell grown adults what they can, and cannot ingest if they are not harming other people. To tell a woman who is dying she can't toke a little reefer? That's cruel.

and I'm also watching america's next top model. good stuff :)

What if they are harming themselves?

As far as toking a little reefer... (shrug) it's still illegal. What will be cruel is when she gets caught and convicted.

One could say we're harming ourselves by eating at McDonald's.

Well, a government body, under a government with a codified set of laws and regulations, has no choice but to enforce said laws. Unless there's a change by legislation to the code, a court cannot decide not to follow a law arbitrarily (unless they were appointed by the Administration). When someone rules from the bench on one persons ability to break a law because they feel sorry for a persons situation... it's a breach of societal trust ( ... )

Edit:Clarifying the doctor activist bit-- I see that the Doctor says it's the only drug keeping her alive, but that seems a little ludicrous to me, given the properties of pot. You're telling me that NOTHING ELSE will give the woman the munchies and kill some pain? But then, we get to the fact I don't know about all other drugs.

I don't trust all doctors. They're fallible, driven human beings with agendas. They're in favor of stupid solutions just like everyone else, like when they prescribed cigarettes for Asthma back in the 30s.

Well, in general, pain killers are prone to causing GI problems, so when it mentions that she has a severely decreased appetite, chronic nausea, and chronic pain, and marijuana addresses all three at once, instead of having her take an anti-inflamatory, an opioid (cuz morphine won't screw ya up more than pot?!), an appetite stimulant (which don't work well in a lot of people), a GI protectant, and an anti-emetic...

this is of course, a generalization, as i don't know the specifics of her case. and as we all know, generalizations are bad, and should never be used.

I don't know, I find them fun. Anyway, thanks for the info on general drugs that might be used. See, I'm pretty sure in her situation I might want to be drugged to the gills until I was gone.. but there's a money issue. And then again... I don't have a tumor, thank G-d.

So am I to extrapolate that if she uses what has been legally perscribed by her doctor, her insurance can bail on her for using illegal drugs, leaving no other (financially) feasable means of therapy?

I would raise the feeble hope of jury nullification, but that requires 12 semi-random people not being ass cobras.

I don't understand the bit about being prosecuted even if living in a state where medical marijuana is legal. Is this all there is to the article?

I think it's a matter of while the STATE of Cali says it's okay to toke, the FEDERAL Government, as in those guys in the Nation's Capital in Washington DC, say it's not okay. And it's the Federal guys who are coming after her.

Okay. Then I guess I'm confused on how a state is able to make a law that defies federal law. What's the point of them being allowed to do that if the federal goverment can come after you anyway?

As far as I'm concerned, having been a palliative care nurse...Marijuana really should be legal. End of story.

Righteous fucking idiots, it'll be a different story when they're suffering on the other side of the fence.

Oh and for what it's worth, in Our Great Nation's Capital (Canberra), a limited amount of pot is legal. So are firecrackers. How very forward thinking of them...
