Yes it would, and there's nothing the cops can do about it unless they can prove their suspect had something to do with the witness's death.

Which could happen at some point. I remember watching one of the cold case shows and the detective said a big percentage of it was interviewing witnesses and alibis once a year to see if any loyalties had changed and they were now willing to testify.
