My students and technicians wrote in the notebooks, but in the particular instance of the unpublished results, that student. Two names are written on each notebooks: that of the student and my name. At the moment, all of the notebooks are in my office on a shelf.
I do wonder, if I just take them and let them take me to court over them? May be that's a solution.
If I were you, I would ask a lawyer. But I would also be very tempted to just take the notebooks, especially if they only contain data related to your projects. If/When they ask you about them, make sure they know that you're more than happy to answer questions about whatever they need. But if you do plan on taking them with you, I would get them out of your office sooner rather than later.
Also, do you have the agreement/arrangements about that particular student in writing? If not, nothing said about it matters. I also agree with the_physicist on pretty much everything said below.
I can't be of any help here, but just wanted to commiserate. That sounds like a very tough situation and you sound like you're trying your best to be fair yet stand up for yourself and your work. I hope it all gets sorted out, and when it does, please let us know the outcome. I have no idea how situations like this are resolved, and would like to know.
