Important, Must-Read Information

Until my personal art website is up and running in full, I am adding my commission information here for your perusal. When the website is complete, this information will be removed and later updated on the website. Thank you for understanding.

Specific Details of the Work Ethic:
* I accept many forms of Commission: Public Non-Commercial (ie, Volunteer and/or Non-Profit Organization Commissions), Public Commercial (Freelance), and Private Commissions.

Licensing

I will not create art that conflicts with the current copyright laws. Nor will I charged for "fan art" if it will conflict with copyright laws. If someone asks me to create such items, I must receive permission in writing to use such characters, objects, logos, etc or I will not accept the commission.

All original artwork is mine under copyright law, whether or not I petition the US Copyright office for the legal confirmation of ownership. However, all finished original works will be produced in a published format (created once yearly) as a collection of works and copyrighted through the US copyright office.

By US Copyright law I retain certain rights even to "Works for Hire". However "Works for Hire" is a special case with very clear and strict rules.

Any "Works for Hire" will require a strict contract agreement with an allowance for my own personal use of works created. (For my professional Portfolio, and as examples of work competed for other potential clients to view).

In the cases of a character or characiture of someone I may wish to make later prints to sell. Such will be discussed on an individual basis. The individual(s) asking for a commission can ask that the piece itself not be resold as prints, etc, as I am using their likeness for the basis of the artwork. In such cases, I still retain the rights to use the piece as part of my professional portfolio of works and for self promotion.

Exclusivity of a piece (ie. no prints allowed for later sale) increase the price of any and all commissions produced to compensate for the loss of additional income.

In any of the above cases, the work itself can not be reproduced, distributed, or displayed by the commissioner for commercial purposes without proper contractual documentation (this covers both of our proverbial rear ends). The only exception is for those artists whose personal character are produced; they may post (publish), share (distribute), or place on a webpage (publish) the artwork for display purposes only as long as proper attribution is added as well. They cannot, however, sell prints of the work or otherwise financially benefit from it in anyway.

All work produced and displayed here in in any other medium is not in Public Domain (unless specifically stated), and only US-legal "Fair Use" will be considered as an exception.

No work is allowed to be altered for personal use without permission. (In other words, get it in writing and we are all good.)

** All the above may be changed at any time, either by necessity or by contract with an individual commissioner. Make sure to specify what you want at the time of the commission. Otherwise the above rules apply. **

All work I create I may use for personal advertisement and promotion (via Professional Portfolio) either digitally (website) or physically (printed / burned to CD).

Any collaborative work and the collective author's rights are protected under the laws of collaborative works.

Unless contracted otherwise, all Licensing of artwork will never remove my ability to produce the art elsewhere for my own needs or benefit.

** Subject Matter **

I reserve the right to accept or reject any commission for any reason. To allow for a better chance at acceptance I have a specific list of things I will & will not create, and appreciate that clients not ask me to create things that are inappropriate in nature.

This includes but is not limited to those things that are, by USA and FL state law, illegal. I won't do it.

** Payment & Shipping **


1) For large or expensive commissions (100+ US dollars), half will be required upfront before work is started. The other half will be required before it is shipped. As soon as the money clears, the item(s) in question will be shipped out asap.

2) Small commissions (Less then 100 US Dollars) require payment upfront before work will be started. EXCEPT for hand-drawn full-character pieces of a smaller size / price. These will be paid as a half/half, as above.

3) Unless otherwise noted, the shipping for the commission will be added to the final price of the piece for anything under 100 US Dollars. Anything over 100 US Dollars, shipping is free unless otherwise stated.

4) Shipping is done by US Ground mail, uninsured. If the buyer wants another form of shipping, they must pay for it.

5) Extras like tracking and insurance are added to shipping costs and are paid by the buyer. For long distance travel, or travel across Country boundaries, this is highly suggested that the buyer purchases insurance or a secured form of shipping. Instances of lost packages have been recorded by various other artists I have spoken with on a regular basis.

6) I cannot be held responsible for missing items once they are out of my hands. (Thus paying for tracking is highly recommended).

7) Also, once out of the US Post Office's Hands, when dealing with over-seas or over-border shipping, there is not much they can do about it.

8) DO NOT SEND ME MONEY UPFRONT. Let me send you an invoice/bill. This helps us both out in the end and protects us both Just In Case something goes sideways from the intended plan.

*Trades:
--> I will trade art for art. This includes trading sketchbooks at conventions, no other cost. (However, I am not required to offer art for artwork you produce for me. A Trade in this case must be agreed to by both parties to be considered valid).
--> I have various online games that I play. If you are a member, you may get a discount for certain pieces of artwork. There may be special artwork specifically for certain games.
--> OR if you offer to pay for my accounts (with my permissions), etc (value for value), you may opt to receive art in trade.

Rates for all art are determined by a simple math equation.

(Wage x hours) + (supply costs) + (size) + (extra features x number of extra features) = Final Price.

Art created on the spur of the moment, including artwork created at conventions, gatherings, camp-outs, girl-scouting events, etc, do not fall under the specific set of pricing rules.

Conbadges are small versions of original artwork. Digital Conbadges are less expensive as only "prints" can be made of them and there is no "real, original".

* Packages are available upon request.

Marketing Packages
This below prices gives you exclusive rights to reproducing, distributing, publishing, etc, the artwork produced at no additional requirements from myself. So you are paying for both the artwork, the work done, and the copyright transfer.

Animation
( Generally each page is between 50-100 a piece. This is based on the idea that you are getting more then a simple single character image. Some pages won't have characters on them, but instead props the character uses. A lot of time and effort goes into a fully finished character sheet, or character Bible. )
