So, I routinely search for my penname for a few reasons. One is to flush out any instances like the plagiarism of a few months back, and the other is to find any recs that I may have missed.

I was doing so tonight when I stumbled across something rather... odd. Apparently an entire LJ community is using my idea of Sex Magic being taught at ( Read more... )

I think they should've contacted you, absolutely. You're right, it's really skirting the edges. Your name should be front and centre on their site. What do you think you'll do about it?

I honestly have no idea, because I don't know that there's much I'm entitled to do. With the other case, it was outright copy-and-paste lifting of my work. This is more... conceptual. It's difficult to know where I stand.

Er. No offense, but how is that anything different than you writing fanfic based around another author's characters, world, etc.?

I put a disclaimer on it, and give proper credit. Which is exactly what I expect of them.

Neither of those things legally absolve you of copyright infringement, though. So I don't see how their situation is any different, copyright-wise.

As far as rudeness goes, now that's another issue entirely. The polite thing to do would be to ask permission before running with the idea. But in your post you were talking about plagiarism and copyright, not rudeness. Or so it seemed to me.

No, I believe I said that I don't have a copyright, and mentioned several times that I wasn't sure that I'm entitled to any sort of recognition in this case. I merely said that I felt cheated, and wasn't sure what I could do about it.

Send the main mod, lvlysenbei, an angry email. Fill it with rage and make your font red -to further express your fury. Make them credit you in the wtf_drarry comm's profile.

*chuckle* Well, I don't think I'm exactly furious. Just a bit perplexed, a little flattered, but mostly feeling cheated. If one of them doesn't get ahold of me (because several of the members also have this journal friended, and are likely to see this post), then I shall certainly be contacting them with my concerns.

I think an email would be good, though not an angry one - there's already enough wank on LJ ;) Also, poster below seems quite willing to talk. Sounds as if it might be sorted out with a couple of emails.

Hello, I am not the mod of the community, but a player.
To be honest, I thought our mod had already contacted you before we went with the idea.

Cait (our mod), has never once attempted to take credit for the idea. In fact, in our OOC Comm (where we generate plans and the like), she linked us to this and went on and on about how amazing it is. Everyone in the comm has read it, I think.
We are not attempting to take your idea, but play upon it and honor it, in a way.

I have not been able to get in touch with Cait at the moment, but I am sure she will see this soon. I promise, no one in the comm is attempting to take credit for this story/idea, in the least.

I sincerely apologize for the misunderstanding, and I will leave the rest to our mod.
Many apologies, and thank you for not flying off the handle. I am sure this was all just a misunderstanding.

Not to mention, say the word and we'll stop the plot line with the classes.
(Of course, I am speaking as one player, but I am pretty sure the whole of the RPG would agree.)

Nope. You guys keep doing what you're doing. Just put a word or two in about borrowing the idea in your user info, with a link back to me, and I'm happy. Hell, I'll probably even follow the community with interest. The person playing Draco has Spoiled-Snobby-Brat down to an art.

I sent Cait an email, more than likely she is asleep (we both live on the EastCoast, so it is rather late for us right now).
If she doesn't see it tonight, she will in the morning.

I can't do much as just a player, she'll be the best one to talk to. I'm just trying to smooth things out the best I can.

Again, many apologies for the misunderstanding and thank you for being so patient.

You should totally have gotten credit. But maybe it's oversight. If you just ask the mod, maybe s/he'll fix it for you.

It wouldn't hurt to ask, anyway. Would it?
