What do those two pictures have in common?

This evening I was passing one of the tables in the young adult section, and the cover of a new book caught my eye. Why, you ask? BECAUSE IT HAD NIGHTWING ON THE COVER. Or rather, his head:

You're right! I didn't make the connection - the pose looked different, and while I noticed the hair was "wrong", I didn't catch this. Doesn't make it better, though.

Nope, it doesn't. But maybe you can buy these images and reuse them or so. I have no idea about the comic book world. But that one is rather obvious, so one would hope that they checked that if copyrights were concerned, no?
