Oral Arguments and Thoughts

This one just popped into my head to want to write about. There are lots of these, but I haven't been good about jotting them down as I think about them or plopping down to write as I have time. Well, then I guess there hasn't been a lot of reflective time either... but that comes with it's own rewards too. But that's a different topic entirely.

The most compelling argument I've heard about this is that is violates the 14th amendment to the US constitution. If the prop 8 amendment gets upheld by the CA supreme court, there will be a federal law suit. If the federal court upholds the amendment, it would set a precedent that states can pass laws that limits the rights of protected classes.

Remember that sexual orientation is a protected class under federal law and there are many decisions from the SCoUS that uphold it's status. If that happens, then I'm willing to bet that some states would try to ban inter-racial marriage or put restrictions on employment. I can't see the SCoUS going down that path.
