Oh. Thank you. I have been thinking about this a lot, particularly because this involves just about every one in my new fandom. It's such a community feel, here, and it's going to be so hard if it has to split up.

But this isn't any different from the Aussie law. They're just basically saying it's an American law as well. Not that we can get arrested, but just that we can't have it on the internet.

But, a law is a law, so it's not LJ's fault, and if you read the Miller Test, it does seem very fair to me. I even agree with it, as long as those judging the situation are fair. Intially, the Milelr Test was meant to be enacted by actualy judges, who are trained to judge things. Some desk jockey at SixApart is a little more iffy. They would do well to hire a small time of trained people to do this full time, or something.

I wouldn't worry about the lj_biz stuff. The Miller Test seems really reasonable, and if what they say about considering each case is really true, I think fandom is mostly safe. Of course, I write things between consenting adults, so my POV is different from someone who doesn't, I guess.

I'm more worried that they feel the *need* to make those posts in the first place. It's like they're setting up a safety net for themselves, and for what? It makes me uneasy, at the very least. But I'm sticking around here for now unless something better presents itself, which so far, it hasn't.
