Election Gloating

Four years ago I wrote a guide for political gloaters. "Resist the urge to simply run around shouting "victory" - not only is it undignified, but it misses the real point of emphasizing all the stuff 'your team' will get to do." So let me do a little gloating, not about the victory itself, but what that victory entails.

We've been trying to send many of them home for years, but either sending them home might threaten their lives (see the Uighurs) or home doesn't want to take them back.

We haven't been trying to send them home for years. We've been using that lame excuse as a reason for their continued detention even after they've been found innocent by a judge.

Judge: They're innocent. Release them.
Prosecutor: We can't send them back. I guess we'll have to keep them here.
Judge: I said they're fucking innocent. You can't hold people in prison if they're innocent.
Prosecutor: They'll be persecuted if we send them back to where we picked them up.
Judge: Maybe you should have thought of that before you arrested a completely innocent guy and spent the last seven years telling us that he's a bad guy. Now we're responsible for placing him somewhere safe, and there are many safe places in our own country that are not jail. You know what? Send him in right now. I'm going to make sure that he knows that he's a free man, because I do not trust you assholes.The current line is that we can't release them into Uighur communities in the United States (as the judges have ordered) because Federal judges have no authority ( ... )

for them to have been military prisoners, they would have had to have been shown to have been POW's who should be covered under the geneva convention rules as outlined in the UCMJ Law that rules the US Military.

But that would have meant that they could not be tried as terrorists, since they were shown to be Military Prisoners - at which point they should have been tried as such...

I mean, don't kids get to read the FM-27 Series, the law of land warfare section???

I think you're confusing cause with effect. They're not being held away from civilian courts and in military courts because the Bush Administration actually thinks that they are military combatants.

The Bush Administration has decided that they want to keep these guys locked away regardless of what they did. Currently the "military courts" argument is convenient, but if someone discovered any rationale by which civilian courts would work better I guarantee that suddenly these guys would become civilian criminal prisoners overnight.

Part of me is ashamed that he didn't win the popular vote by double digits in times like these, and part of me is amazed that he even made it out of the primary.

I've been trying to find a way to word that.

Although I agree with you, I am also cheering. Because I feel like we have a chance now, and that's more than I've ever felt.

Know what's fucking amazing? Rookie first-year Senator with no war chest who Intrade had at less than ten-to-one odds came out of nowhere to beat Clinton's team, then Rove's team. That is one of the biggest goddamn astonishing "come-from-behind" victories in a very, very long time.
