Wow, I'm really grateful Alun and everyone involved in teh accident are okay! I hope things work out well for the both of you. One concern, though; has Alun ever blacked out like this before? If this is a problem that has previous occurred and of which he was aware, he may be liable. If, however, it was a sudden illness of which he had no warning, you're probably good.

*hugs and wishes well*

Thanks for the well-wishes. ^_^ Your concern is pretty much what we're trying to figure out right now; just before he passed out he was having stomach pain, which has happened before--not for years now, but sometimes the scar tissue from the appendectomy he had when he was three will act up. He's never blacked out from it before though, which is the part that might help our case (?) but nevertheless makes all of us a little nervous. Even if we do end up being liable I think we'll be fine, and since they'll pay to get him in to see a doctor, either way we'll get to figure out if there's anything else wrong. Which, to me at least, is the important part.

Something like that should be okay. The cases I've read with similar fact-patterns to this have involved people with epilepsy; if you've never had an epileptic attack before, or had one ten years ago and believe it's controlled by medication which you're taking faithfully, and you suffer an attack that causes an accident, you're not even being negligent because you didn't know and had no reason to know that there would be a problem. Thus, if Alun's never blacked out before and had no reason to know that he would black out, he should be okay.

Good to know. And thank you--the lawyer perspective is very, very much appreciated. ^___^

Hang, on, doesn't BYU require all students to have health insurance? Like, they bill them at the start of the year if they can't prove coverage under other health insurance?

(On a purely differently level, I find this all fascinating. My dad is a claims adjuster and worked with auto insurance for most of my life.)

Glad he's okay. And this might be a blessing in disguise. The last time my brother totalled a car (yes, the *last* time) the insurance got them through a really really tight several months financially. I think it was close to when he lost his job. They could, like, eat and pay the mortgage and stuff because of that accident. (Granted, they were down a car.) Who knows how this might end up being a good thing in the end, especially since no one got hurt (and in spite of being non-collision insured.) Good luck with everything, and I hope Alun is feeling much better after your exciting weekend. *hugs*
