Could you say something about the lack of subs on the distribution, i.e that it was broadcast on $channel with subtitles so users who are deaf/HOH could reasonably expect the DVD to come with subs too? It
isn't Virgin's fault, it's the distributers fault. Deaf friends say Virgin always exchanges nonsubbed stuff.
As I understand it, it doesn't apply to products themselves, or broadcasting regs. This is why so many TV channels don't do subs yet. There is complex legislation which is meant to be phased in over the next decade which increases subtitling/signed output.
So you could kick off using the DDA if the shop/website wasn't accessible, but I don't think you can if the product doesn't have subs/audio description etc etc. See rant above about distributors not being required to ensure subtitle streams are included like one would with audio and video etc etc.
