On the road again

In an hour and a half or so, I'm going to get in the rental car with Graham and Celosa and we will go to the ranch. This means that we'll go the same route that ended in the wreck. I anticipate drastically different results, this time, but it doesn't mean I'm not nervous about it ( Read more... )

they way it works is thus: liability sounds pretty clear - he's probably 100% at fault. So his carrier will be trying to get a statement from him. If he doesn't cooperate, they *may* exercise their right to deny his claim for non-cooperation. If that happens, your policy will pay as uninsured motorist. Most carriers don't penalize the third party if the insured refuses to cooperate, though - they may not pay his own car damage, but they'd probably honor your claim, especially if they get enough information from witnesses, etc., to show what happened and it's clear he's liable. Either way if you have medpay or PIP - I can't remember which is on Texas policies - your insurance should pick up whatever you are out of pocket after your health insurance pays. They will be subrogated on your recovery from the other carrier.

We have PIP. USAA has been great, and they suggested submitting receipts to both carriers, just to be on the safe side.

The Farmers person has already started the claims process with us, so I don't think that they'll go the non-cooperation route.
