When Sarah gets angry (after Dave's rant about Rita), she says "When did you find out?...Was it just before you bedded me for the first time?" So this seems to insinuate that they actually went all the way before Evie walked in on them?!? Did anyone else catch this? Also, i don't think that walking in on your parents is all that damaging, just embarrassing (it happened to me once), and Evie obviously doesn't know what it was that they were up to.
ETA: Am i wrong in thinking that if the kids aren't Dave's then he gets no money? I am assuming it would all be put into four trust funds.
That does assume that the compensation money is for the upkeep of the children, and not for Dave's loss - as they were unmarried, that might be true. So he might lose his children and be broke and homeless soon. :( But I'm not up on Scottish law, so ... In America, I think they were together long enough to be considered common-law spouses, but I don't know how long-term residence carries over into legal benefits in other countries. ::not helpful::
I'm no expert either, but it's a misconception over here (UK) that "common law" conveys the same rights as marriage -it doesn't. I imagine that compensation would go to Dave automatically if he and Rita had been married, because he'd be the kids' legal guardian. But as they weren't married, he's not their guardian in law. I'm not sure whether compensation would then be put in trust for the kids or whether Dave would get a share of it as Rita was his partner.
