The court ruled that Prop 8 wasn't retroactive, so those marriages stand. All they ruled on was the legality of amending the constitution through a proposition.
I'm hearing that it technically did not revise the constitution and therefore does not violate any state laws. But since the marriages prior to the passing of Prop 8 are still legally recognized it opens the door for a discrimination case because some were able to marry and others are not (now).
This pisses me off so much. I've read some of the technicalities on it, but still.
I really don't understand why this is so threatening to people! Some of the same arguments against it, same bible quotes, are the ones used to forbid interracial marriage too.
It's bigotry, plain and simple. There *is* no rational reason and that leaves the irrational. I guess it could be insanity, but I'd think bigotry was more prevalent.
I *saw* that! *VERY* impressive. I will give the court this: they can only rule on the contents of the lawsuit. Seems like the angle of the new suit gives them more leeway.
