Kenneth Feingold was on the radio this morning and was discussing his role in several mass settlement deals where victims of various events attempted to receive compensation through large funds set aside for that purpose. And yet the Constitution was secured with a whiff of grapeshot against the Whiskey Rebels, while its ratification system was deliberately designed to short-circuit the existing legal system, and what had made it ratified was the inability of the government to sufficiently tax to preserve its military security against enemies at home, enemies who were well, angry they hadn't been paid but had been overtaxed.

And yet the actions of the Founders take the strict constructionism argument and run it through a meat grinder and make pies out of it.
