:( no more livejournal? but this is the easiest way for me to follow you guys! you could always copy and paste the same posts from your blog, wherever that is.

As for the resident, I am forced to agree with the manslaughter charge. As you and the newsclip agreed, being overly tired IS like being drunk. It's not safe to drive. You can always take a cab or public transportation or call a friend. Furthermore, driving overly tired is almost less of an excuse because your judgment isn't impaired the same way it is with alcohol. Not that you're thinking clearly, but its a different type of cloudy judgment than with alcohol.

So in short, don't drive drunk OR overly tired. Alex Trebek once crashed because of that too.

We actually talked about this sort of thing (though not this exact case) in my sleep class last year, since apparently half the class was pre-med. The suggestion was that you should take a taxi if you're that tired. I think some hospitals have programs where they'll either call a taxi for you or have some service that takes you home afterwards. That's probably only a few though. Apparently there are also studies that show that residents make more mistakes towards the end of their shifts.

Also (and you can thank my pharmacy law class for this one), driving while exhausted may be comparable to driving when you know you have an uncontrolled seizure disorder. Which can definitely get you manslaughter charges.
