Dude, I am sorry to hear about the accident. The only good thing about this is that it obviously was not your fault and you should be able to get a decent check from his insurance company for pain and suffering. (in addition to fixing your car)

Really? Money's good. It makes me feel really good. Is this the kind of thing I should get a lawyer for or will I talk to my insurance company about that?

okay.. I see two ways to do this..1. You can check the yellow pages and call a lawyer who specializes in traffic litigation. He/she will have a recommended doctor for you to go to and will handle all contact with the faulty driver's insurance company. There should be no cost to you except a percentage of the settlement. (I know it sounds kind of sleazy doesn't it)

2. or you can go to your doctor. Document all bills and time spent. Your pain and suffering is worth some cash and insurance companies have people assigned to handle cases like yours. When you talk to the other driver's insurance explain that you have experienced some pain and that you have seen a doctor and expect some sort of compensation for your expenses.

3. Also, you might want to google: "What to do after a car accident" for more information...

Joggers?!? Are you serious? I don't think he was supposed to admit fault.

I mean on this accident. Ken took info down, tec. Have you talked with them yet? Have they set anything up for you or advised you on injury?

Oh... so far they've been alright. I only dealt with the folks who help file the claim. The actual agent assigned to my claim should be calling me today.

The most I have set up right now is the name and location of a shop where I need to bring my car.

As far as injury... they asked if I was hurt. At the time I said "No" because all I felt was shaken up. Now, my back is sore as a mutha and I'm starting to get some neck pains. I'll probably go see my doc once I figure out what I'm doing rental wise or whatever.

Hope you come out of this without feeling anything other than sore. Do you have a big seatbelt bruise?

No seatbelt bruise... but the top of my back is just TENSE and SORE. Soo much so that I felt the need to use caps on those two words.

Oh that fuckin' sucks. Glad you're okay, and at least the fault is all with him and his insurance.

Thanks. Yeah... it's obvious that he's at fault.

Ken was seriously a life saver. I felt bad for ruining his night with all that.

When he dropped me off, I tried to be polite and invite him in or whatever. He was like "Nah... I'm gonna go home." to which I responded "Fucking good, because I'm beat and I just wanna go to sleep."

Man, sorry to hear about the accident. I'd definitely swing by the docs just to be sure you've not permanently screwed anything up, and let the guy assigned to your claim know you're going to do this when you talk to him.

Overall, the insurance process usually isn't too bad. My experience has been that you file the claim, they'll either send someone out to do an assessment on the car or tell you where to take it. They decide how much damage there is, if it's totaled, they'll just give you a check and you go shopping. If not, then they will either pay the body shop directly for the repairs, or pay you and you then pay the body shop.

Again - sorry you've got to go through this, even with no injures and it being pretty straightforward that it's NOT your fault, it's still a pain in the backside.

Actually, it's developed into a pain in the upper backside... right around the middle of my shoulders. hehehe
