In case you are wondering what I'm talking about, it is the fact that the fifth and eleventh circuits have split over whether or not banning dildo sales is unconstitutional. The fifth circuit just denied rehearing, so I'm excited. (Also, I'm amused that the name of the post in the first link

I mean, worst thing that happens- the supreme court says that the status quo is cool, and people in Alabama still have to use the internet to buy sex toys.

I mean, this is probably a blessing in disguise, because I find it hard to believe that any sex shops that would open in Alabama would be sex-positive, feminist sex shops... those generally only exist in hippie places. :(

Though of course, I would be sad to know that substantive due process, constitution fiction though it might be, doesn't protect sex toys. SEX TOYS. How do they expect their women to orgasm? Seriously.

On a very silly level, I can't see that banning dildo sales would be constitutional. I don't think Our Forefathers lived in a world where they even existed xD

But it would be hilarious to see people duke that out in the Supreme Court.
