COVINGTON, Ga. (May 24) - A man accused of driving a car that struck two sisters and their three small children faces new charges after the youngest victim of the attack died Wednesday, authorities said.
"There was clear intent to injure the people. It was obvious," Police Chief Stacey Cotton said. "This was absolutely not an accident."
The car struck the five, hit the restaurant, then backed up and hit them again Tuesday at a McDonald's parking lot, police said. All five were hospitalized, and 2-year-old Avery Nicole King died Wednesday.
Cotton said Wednesday night Lanny Barnes, 46, now faces additional charges in addition to the original five felony charges of aggravated assault.
Cotton also is charged with four counts of aggravated battery, one count of felony murder and one count of malice murder. Warrants for the new charges were issued Wednesday night and personally served to Barnes, Cotton said.
Barnes appeared before Chief Magistrate Judge Henry Baker on Wednesday and was ordered held without bail pending a mental health evaluation.
The girl's death was originally announced by her uncle, Paul Casola. She died at Children's Healthcare of Atlanta.
"Pray for us as we move forward in life without Avery," said Casola, a Covington minister and the husband of the other adult victim in the attack.
Casola said the family would find a way to move forward, but, he added, "forgiveness is not the responsibility of the justice system."
Cotton said it is "extremely premature" to say if the death penalty will be sought in the case.
Barnes' mother, Mary Barnes, said her son has suffered depression for years.
Anthony Carter, chief assistant public defender with the Alcovy Judicial Circuit, represented Barnes at Wednesday's hearing. Carter indicated Barnes' mental health could be a factor in the case.
"We are beginning a full investigation into all aspects of this case, including Mr. Barnes' mental capacity at the time of the incident, as well as past mental health treatment," Carter said Wednesday.
There was no apparent connection between the victims and Barnes, according to Cotton, who said authorities have no motive.
"I've seen some pretty heinous things occur, but nothing like this with no explanation," Cotton said. "That's the strange thing. That's the big question mark: Why?"
Cotton said he would not comment on eyewitness reports that Barnes was smiling and laughing in the car after hitting the victims.
McDonald's worker Ryan Boldman-Snyder, who said Barnes "smiling the whole time," said he and others chased Barnes car when he drove away from the McDonald's parking lot in an apparent effort to flee the scene.
Cotton said officers stopped the car and made the arrest only a few hundred yards from the restaurant.
Cotton said he is awaiting results of blood and urine samples taken from Barnes Tuesday and sent to the Georgia Bureau of Investigation's lab.
A Newton County jail clerk told The Newton Citizen that Barnes was arrested twice in 1993, for public drunkenness and discharging a firearm in the city limits.
The police chief praised McDonald's employees and customers who tried to apprehend Barnes and assist the victims.
One employee took one of the injured children to a nearby hospital, "possibly saving that child's life," Cotton said.
"It would have been a lot worse if some citizens had not jumped in and started pulling people away from the car," Cotton said.
Anita King, 36, of Asheville, N.C., was treated and released from Newton Medical Center on Tuesday, said hospital spokeswoman Stephanie Barbour.
Stephanie Casola, 33, of Covington, was listed in fair condition Wednesday, Grady Memorial Hospital spokeswoman Denise Simpson said.
Casola's children, Jacob Paul, 4, and Isaac Raymond, 3, were in serious condition at Children's Healthcare of Atlanta.
