Legal, but not polite. It would be legal for me to follow you in the street, videotaping you and taking pictures - but we would still see it as an invasion of privacy, like obviously listening to a conversation in a restaurant.

I think the more interesting question is what will happen when devices like google glass become common - when people can be permanently monitored without their being aware of it. Given some of the things I've seen on Flickr (which is a pretty clean website, considering it's open and can be free, I have no doubts that lots of people will get their jollies intruding on other people's privacy. Trolling in real life, if you will.
