I do live in an apartment... but it is not a complex, it is an old 3 story home that has been converted.

In our lease, it states that we have no grounds to complain about tobacco. When i signed it, I naively assumed that it was referring to smokers who would be smoking around the property, and in their own homes. And, cigarettes, while vile, don't seem to penetrate floors of a building the way terrible cigars do. So i thought nothing of it.

I'm guessing that clause was added because of this man.

Still, a call to the health department couldn't hurt.

1) that clause is *probably* unenforcable, especially if you go to a doctor and have some medical back-up for it causing an issue... at the very least, it would get you out of the lease without problems from the landlord (granted, then you'd have to find somewhere else to live, but still.....)

2) in terms of helping the problem at present... the best way to get rid of smoke, of whatever variety, is controlling air movement---ventilate as much as possible, have fans going all the time (just to keep the air in the apt), and, if you can, try plugging vents/crevices/etc that lead to his place with towels or other cloth.

3) febreeze. and running things through the dryer. does wonders for getting the smell out.

what's sad, is these are the sorts of things i do in my apartment, to ensure my neighbours don't have to deal with my smoking. it's entirely possible to smoke.. well, just about anything (heh), and keep it toatlly contained. provided you're willing to be the least bit considerate of other people, of course ( ... )
