morgandawn has posted very helpful, step-by-step advice on fandom_lawyers about what to do after you're served a C&D or take down notice: Fannish Guide to Legal Notices: C&D Letters/Take Down NoticesI know a few members of my friends list have been subject to Cease & Desist Orders in the past and that they had to figure out what the hell to do all by themselves, with a ( Read more... )

I feel like this should be spread amongst the masses in fandoms everywhere.

Definitely! If you think it'll help, post the link on your LJ and spread it around! It can't hurt.

A few years ago, it seemed like half of my friends were being slapped with C&D letters and I felt completely useless, not knowing what to do. I'm glad someone put this together - it'll certainly prove helpful to someone in the future! Hopefully no one I know, but I wouldn't count on that...

Did you hear about the Supernatural fan that got slapped with a C&D by Jensen?

Yes. I have to say, I kinda agree with Jensen's lawyers on that one - that website was really, really embarrassing. "Help Jensen help himself!" and "He's illiterate!" and then videos of him having trouble with his lines or whatever. I'd certainly be pissed if someone did that to me. :(

This is good info... for years, an internet amigo of mine used to make UNBELIEVABLE replicas of the archaeological items from Indiana Jones ( http://www.indyprops.com/ )

This was never a problem until Indy IV came out (he even got "good stuff!" emails from some of Lucas's prop makers). He got a C&D order from Lucasfilm (I guess understandably so), and they threatened him with all manner of legal action. Scary stuff.

That's the most irritating thing: them being fine with your existance and then suddenly NOT. Ridiculousness. :(

Yep. THAT is what truly makes no sense.

Heh. I linked to this on mine because of the Jensen wank - I really hate the "call to fandom!" crap, especially when there's: 1. no solid info and 2. the "with us or against us" mentality.

Plus blaming Jensen (or more likely, his reps) for protecting his image? Bad form. Even if he *did* sign it personally, I really couldn't blame him. There's being like The Onion, and then there's vaguely observable attempts at humor with teeny tiny disclaimers.

I seriously searched a while to find the disclaimer on the site when I first found it. I really can't blame *any* public figure for taking action against a site that juvenile.

I definitely can't blame him or his lawyers for protecting his image. I'd seriously be furious if anyone posted that sort of stuff about me on the internet, even if it was in good fun.

Didn't they learn their lesson in middle school? Even if everyone is laughing, it doesn't make it okay.

Glad to be of use! And as I understand it, he didn't sign the C&D - his lawyers did.

:D Yeah, I figured as much, but some were *convinced* that he did everything! Yeah...like production shuts down for him to sign papers all the time...FAIL.

Maybe future wank can be avoided with this info. Thanks!
