Landlords?

Do I have to tell my landlord that we're having a baby? He mentioned when we moved in that he wouldn't have rented the apartment to more than two people because it's so small, so I'm worried that he might kick us out if there's another "person" there. I'm pretty sure it's illegal to discriminate against renting to parents with small kids, but I'm ( Read more... )

Take a good look at your lease agreement. If it says something about no more than 2 people are to live here at a time, he might have cause to evict you. But that said, most landlords won't kick out a family that pays the rent every month. At our old apartment there was a family who signed a lease that stated no more than 4 people would be living in the 2 bedroom apartment. There was 2 adults and 4 children that moved in. No matter how late they paid the rent, it was always paid, so the landlord turned his head.

I don't think I'd worry about it, but you should probably prepare for the worst just in case. Maybe just set aside a little money each month? Best case scenario is you won't need it for a new place and can use it after the baby is born :)

In our one bedroom, only two people are allowed. In the 2 bedroom, only 4 people are allowed. Baby doesn't count as a "person" until s/he is one. That's how it works in my apt complex in Ohio. :)

He legally cannot kick you out while you are pregnant. He has to wait for your lease to expire and then at least 30 days before lease expiration send you a non-renewal letter.

If its a 1 bedroom apartment most counties/states have occupancy limits where there its 2 people per bedroom.

I am a property manager and have been in 3 different states so far it has all been the same but you might want to look up California's Tenant/Landlord rights. You should be able to find them online somewhere.

Good Luck.. Moving does suck. :( And a baby shouldn't be the reason a landlord gets rid of decent paying tenants...

When my ex and I were looking for a place, we were going to just get a one bedroom for one year. Our son was only about 4 months or 6 months and the apartment refused to let us get a one bedroom, even though we coslept. She said it was against the law to have three people in a one bedroom.
