Surely Le Tigre would have had to give their permission for the advertising? Which is a bit odd - to say the least. They're a great group though, saw them at the BDO last year and they were very impressive.
well actually it is unlikely that le tigre was ever actually asked if the song could be used. chances are nivea paid for a licence to the track from apra who would have gained the right to grant such a licence from their reciprocal agreement with the collecting society in america that le tigre's repitoir is on. and the chances are that membership was paid for by their record label.
nah, le tigre would have had to say yes. Cause i remember reading an article on a similar issue with The Knife being asked if they could use Joze Gonzalez version of their song Heartbeats for the bravia ad.
whether or not someone is asked in good faith if a corporate entity can use their music is irrelevant legally speaking if they don't actually own the rights to the music, which tends to be the case for large record labels and music distributors
Le Tigre let Telus use "Decepticon" in a TV ad a couple years ago. Telus is Telephone and Communications company. Don't know what that song had to do with either voicemail, internet, or wireless mobility :P But when Le Tigre were in Vancouver a couple years ago, they were asked about it in an interview. They just needed the money. Fair enough I guess.
