Under FCC Part 97 rules, subchapter 544 ("Fur-Bearing Mammals"), a bear holding an Ursine Auxiliary Radio-Telegrapher (UART) certificate may operate CW on the 40m and 15m bands year-round, under the guidance of a General or Extra-class licensee. From April to September, to accommodate the increased bear activity outside winter months, and taking into account the higher danger of forest fires during summer, CW operation is also permitted on 30m and 12m bands, plus RTTY on the 12m band. No provision, however, is made for phone or other modes of operation. (Similar rules prevail in Canada.)
