So, I went to go see how they were 'legally obligated' and I found this in their Student Handbook (http://www.kisd.org/khs/files/2010-2011%20Student%20Handbook.pdf):

"Engaging in inappropriate physical or sexual contact disruptive to the school’s environment or disturbing to other students or staff members."

Disturbing meaning practically just about damn near anything.

At my school (I don't know about others or this school) a student handbook was a contract between the school and the students/parents, you have to agree to the handbook or you don't go school.

If S.W. were engaging in "inappropriate physical or sexual contact" (whatever that is) while in the school building, I could see a case for telling parents. Although ffs, the important note there should be "your kid is having sex at school", not "your kid is gay", because only one of these things is a problem and only one of these things does the school have any business dealing with.
