Are servers even paid minimum wage in that state? They certainly aren't in VA.

How aren't servers paid minimum wage? Surely the point of a minimum wage is that nobody is paid less than it.

I think usually servers get paid about half(?) the actual minimum wage, and then are expected to make up the rest in tips. Which is why tipping is so vital for them. It sucks.

*headdesk* That is ridiculous. Though it goes a long way to explain why Americans tip more than we tend to do in Europe.

I'm ok with paying an extra 35 cents if it means servers won't starve despite working.

Seriously. I felt like driving to KY and going to Papa John's fucking mansion with its goddamn moat and screaming "I'LL PAY A FEW CENTS MORE FOR YOUR STUPID FUCKING PIZZA, GIVE YOUR FUCKING EMPLOYEES HEALTH INSURANCE YOU CHEAP BASTARD!"

Fucking asshole businesses like this are why I always tip in cash and make sure that cash goes into my server's HANDS. If I went to a place that tried to tack on that extra fee I'd be tipping my server even more.

Assholes. So many fucking assholes in the world. GOD FORBID you share your profits with the people who make them possible!

Cash is preferable, but jsyk servers are legally obligated to declare their cash tips just like they do their CC tips. (And it gets taxed, etc.)

I'm aware of that; I just feel better when I see it go into their hands rather than tacked onto a CC where I don't know that they're actually getting it. Yeah, I know it's always possible that the employers can still try to jerk them around but that's a little more blatant than "Oh, well, we had to pay credit card fees so your share is X."

I usually eat out on credit but there seems to be a few times now where I'd check the credit card bill at the end of the month and we weren't charged for the tip amount I would pen in. :/

"But to blame it on a fair minimum wage law is petty."

HA! It is not petty, it is reality. Costs go up, prices go up. The owner just wants you to know why. I get surcharges all the time on my bills for sudden rises in gas prices.

TINSTAAFL.

(The skimming tips thing is not OK, though. That is called theft and any restaurant that would do it should be prosecuted. The surcharge, though? Actions have consequences. 35 cents seems pretty light to me, but I guess the guy's run his numbers.)

If you can only stay afloat by paying your servers the absolute bare minimum required by the government, then maybe your job deserves to fail.

Maybe. Of course, if the business fails what do the servers get paid then?

Perhaps they could find employment at any of the other restaurants that aren't making a stink about this.
